VOTING RULES AND FREQUENTLY ASKED QUESTIONS
How can I place my vote for the winner of the final spot on the first cycle of "The Fashion Show"?
Voting is simple and easy. To vote, simply go to http://www.bravotv.com/style/the-fashion-show-vote (the "Website"). The on-line voting period will commence at approximately 2PM, ET on February 4, 2009 and end at approximately 3PM, ET on February 13, 2009 (the "Voting Period").
Can everyone vote?
Anyone who is a legal resident of the United States may vote for his or her favorite potential contestant out of the two (2) potential contestants posted (the "potential contestants") for the final spot on the first cycle of "The Fashion Show." Voting is not limited to a certain number of votes per person throughout the Voting Period, so vote as many times as you like. Bravo Media LLC ("Bravo") and Bongo, LLC ("Producer") do reserve the right to limit the number of votes (or to change any limit on the number of votes), in their sole discretion. Notification regarding any such change will be posted on the Website.
How do I find out the results?
The one (1) potential contestant chosen for the opportunity to appear on the first cycle of "The Fashion Show" will be announced on http://www.bravotv.com/style/the-fashion-show-vote or on the first cycle of "The Fashion Show" (as determined by Producer and Bravo in their sole discretion) after the close of the Voting Period, on a date and time determined by Producer and Bravo. The date and time of such announcement may be several months following the close of the Voting Period.
How is the winner of the final spot on the first cycle of "The Fashion Show" determined?
The potential contestant who receives the most valid votes by the close of the Voting Period, signs the agreements and releases required by Producer and Bravo, and who in Producer's and Bravo’s sole discretion, meets the eligibility criteria, and satisfactorily passes all diligence checks administered by Producer, as determined by Producer and Bravo in their sole discretion, may be announced as a contestant on the first cycle of "The Fashion Show." If the potential contestant who receives the most valid votes does not meet these criteria, the other applicable potential contestant may be considered the winner if he/she meets the criteria. If there is a tie between the potential contestants and both potential contestants meet these criteria, the winner will be selected by Producer and Bravo, in their sole discretion. In addition, Producer and Bravo may, in their sole discretion, choose to include both of the potential contestants to participate in the first cycle of "The Fashion Show" provided that they meet the criteria described above. Bravo or Producer may elect to discard the results of the vote at any point by the public in the event that no one meets the criteria set forth above herein. Bravo or Producer may also elect to discard the results of the vote at any point and choose the winner of the final spot in the event that Producer and Bravo determine, in their sole discretion, that the on-line voting has been compromised by any means, including through the use of any technical enhancements designed to generate significant blocks of voting for a given candidate. Producer and Bravo may then decide to discard the results of the voting process, in whole or in part, revise or reset the voting process, and they will not be obligated to select anyone through this voting process and will have the right to cast whomever they choose based upon their own selection criteria.

The Voting Period is subject to change in Producer and Bravo’s sole discretion. For changes to the Voting Period, log on to the Website. Producer and Bravo shall have the right to void any vote that appears, in its sole discretion, to have been made by a person not meeting the eligibility requirements set forth above and the right to permanently disqualify from any voting any person it believes has violated these Voting Rules. If for any reason the voting is not capable of being run or implemented as planned, including, but not limited to, as the result of infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, or the use of any technical enhancements designed to generate significant blocks of voting for a given candidate or any other cause beyond the control of Producer and Bravo, which is likely to or actually corrupts or affects the administration, security, fairness, integrity or proper conduct of the voting, then Producer and Bravo reserve the right, in their sole discretion, to withdraw the transmission of any vote and/or to terminate or suspend the voting at any point and declare the voting results based upon the votes up to that point. In the event of technical difficulties with the voting, Producer and Bravo reserve the right to review the votes for accuracy and to take any appropriate action, including, without limitation, voiding the votes cast during the time period in which such technical difficulties occurred. Bravo, Producer, and NBC Universal, Inc. and its subsidiary and affiliated entities ("Released Parties") are not responsible for any computer, network, technical, electronic, human or other errors or problems of any kind, for any injury or damage to participants or to any person’s computer relating to or resulting from entering or downloading materials or software in connection with this vote, or for votes that are stolen, misdirected, garbled, delayed, lost, or late. By participating, each individual agrees to release and hold the Released Parties and their respective parents, affiliates, subsidiaries, and each of their respective directors, officers, employees and assigns, harmless against any and all claims and liabilities of any kind arising in whole or in part, directly or indirectly, out of their participation in this vote.
These Voting Rules are subject to change at any time at the sole discretion of the Released Parties. Void where prohibited.
Caution:
Any attempt by an entrant or any other individual to deliberately damage any online service or website, tamper with the voting process, or otherwise undermine the legitimate operation of the voting is a violation of criminal and civil laws and should such an attempt be made, the Released Parties reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.
